(hereinafter also referred to as "We"),

as the data controller, informs you as a user of the website or as a user of the FIXED SMART application about the collection of personal data and the privacy policy described below.

Privacy policy and sending commercial communications

By registering for the FIXED SMART app, the user's personal data (hereinafter also referred to as "Personal Data") is processed.

Personal Data is processed only for the purpose of using the application and, if the user has given consent, for marketing purposes.

Personal Data may be disclosed to the following third parties:

• external accountants
• auditors
• external law firm
• persons providing server, web, cloud or IT services or business partners of the Seller

Personal data will not be disclosed to third parties outside the EU and EEA.

Personal data will be processed for the period of time we provide you with our services or perform a mutual contract, for the period of use of the application, or for the period necessary to comply with archiving obligations under applicable law, but no longer than 10 years from its termination.

In accordance with data protection regulations, the user has the following rights:

The RIGHT OF ACCESS to Personal Data, which means that he/she may at any time request confirmation as to whether or not Personal Data concerning him/her is being processed and, if so, for what purposes, to what extent, to whom it is disclosed, for how long it will be processed, whether he/she has the right to rectification, erasure, restriction of processing or to object, where the Personal Data was obtained from, and whether or not automated decision-making, including possible profiling, is taking place on the basis of the processing of Personal Data. He or she also has the right to obtain a copy of his or her Personal Data, the first provision of which is free of charge, and further provision of which may be subject to a reasonable charge for administrative costs.

The RIGHT TO CORRECTION of Personal Data, which means that it is possible to request the correction or completion of Personal Data should it be inaccurate or incomplete.

The RIGHT TO DELETE Personal Data, which means that Personal Data must be deleted if

(i) it is no longer necessary for the purposes for which it was collected or otherwise processed,
(ii) consent is withdrawn and there is no further reason for processing
(iii) there is an objection to processing and there are no overriding legitimate grounds for processing
(iv) the processing is unlawful; or
(v) a legal obligation requires it.

The RIGHT TO LIMIT THE PROCESSING OF PERSONAL DATA, which means that until the disputed issues regarding the processing of Personal Data are resolved, specifically if
(i) the accuracy of the Personal Data is disputed,
(ii) the processing is unlawful, but instead of erasure, only restriction of processing is requested,
(iii) the Personal Data is no longer needed by the Party for the purposes of the processing,
(iv) or where an objection to processing has been raised, the other Party may only store the Personal Data and further processing is subject to consent or that the data is needed for the establishment, exercise or defence of legal claims,

The RIGHT TO DATA PORTABILITY, which means that the data subject has the right to obtain his or her Personal Data, which he or she has provided to the other party with consent to processing or for the purposes of performance of a contract, in a structured, commonly used and machine-readable format and, where technically feasible, to have that data transferred to another controller.

The RIGHT TO OBJECT to the processing of Personal Data, which means the ability to object in writing or electronically to the processing of Personal Data.

All the rights set out in the preceding paragraph may be exercised either in writing by registered letter sent to the address of the registered office or electronically at the e-mail address info@FIXED.zone

The data subject has the right to lodge a complaint against the processing of Personal Data with the Office for Personal Data Protection at: www.uoou.cz.

The provision of personal data is required because it is necessary for the proper functioning of the application or is required by law. Failure to provide the data may result in the application not being able to be used.

There is no automated decision-making or profiling based on the Personal Data processed.

Scope of processing of Personal Data

When you contact us through the website, you may be asked to fill in certain information about yourself or your company. This information may include, but is not limited to:

• your name and surname,
• company name
• address or registered office
• identification number and tax identification number
• telephone number or e-mail address.

User registration is required to use the FIXED SMART app. Users consent to the processing of the following personal data:

• your name and surname
• email address

Based on the user registration made in the application, the user can access his/her user interface.
Access to the user's account in the application is secured with a username and password. The user is obliged to maintain confidentiality regarding the information necessary to access his/her user account and acknowledges that we are not liable for any breach of this obligation by the user.

Purpose of processing

We use the data you provide to us to contact you back and provide you with the information you have requested or for the purpose of fulfilling a contract, i.e. making an offer or sending you commercial communications about new products, or for the purpose of ensuring the functioning of the FIXED SMART application. The controller also processes personal data for internal analytical purposes in order to ensure the highest quality of the services provided. All personal data is processed in a lawful and transparent manner and only adequate, relevant and necessary data is requested in relation to the purpose of processing.
In addition, we may use your name, surname and email address to send you commercial communications, i.e. to inform you about events, publications or services we provide that we think may be of interest to you. The provision of personal data for the purposes of performance of a contract and the provision of personal data for the purposes of responding to enquiries or information requested by you is a contractual requirement of ours and failure to provide it may result in a failure to enter into a contract or to respond to enquiries raised by you.
In addition, you may refuse the processing of your personal data for the purpose of sending you commercial communications at any time and this will not affect our other relationships with you. Simply send us an email with the relevant request to info@FIXED.zone or any other address from which you have received commercial communications from us.

Period of processing of personal data

We will process personal data that we process on the basis of your consent until you withdraw your consent. To withdraw your consent, simply send an email with the relevant request to info@FIXED.zone.

Other data processed

When you use the FIXED SMART app, we collect basic information about your device (e.g. operating system version, phone type, etc.).
For the FIXED SMART app to work properly, the app must constantly monitor whether the phone is connected to the FIXED SMILE Bluetooth watchdog. If the phone is disconnected from the FIXED SMILE Bluetooth watchdog, the app records the last known location.
The FIXED SMART app requires the following permissions:

• Location access (via GPS and network)
• Media accessStorage access
• Camera access
• Bluetooth access
• Notification enable

We use third party cookies on our website to analyse traffic. The third party in our case is Google. More information. In addition, we also use short-term cookies that are necessary for the proper functioning of the site, specifically the contact forms. These cookies remain stored on your computer only until you close your browser, after which they are deleted. They do not serve to identify you.
