Collection: Rules of competitions on social networks of FIXED.zone a. s.
1. Competition organizer
The organizer of the promotional consumer contests under the user name "fixedcesko" on the social networks of the company META (hereinafter referred to as the "competition") is FIXED.zone a. s., IČO 26036363, with its registered office at Kubatova 6, 370 04, České Budějovice, Czech Republic, entered in the register maintained by Regional Court in České Budějovice, registration number: B 2491 (hereinafter referred to as " Organizer " or, in connection with the processing of personal data, "Data Controller").
2. Date and venue of the competition
The competition takes place on the territory of the Czech Republic and Slovakia (hereinafter referred to as the " place of the competition ") through a profile on social networks, under the username " fixedcesko ". The date of the competition is specified for individual competition entries. The duration of the contest varies, according to the information provided on this profile.
3. Contest participants
Any natural person - consumer who meets all the conditions of the competition (hereinafter referred to as " participant " or " competitor ") can participate in the competition.
Employees and related persons of the Organizer cannot participate in the competition. If the winner is a person who is an employee of the Company, the prize will not be awarded to such winner. Similarly, the prize will not be handed over if the Organizer discovers or reasonably suspects that there has been fraudulent or unfair behavior on the part of the relevant competition participant.
4. Participation in the competition
The participant participates in the competition by fulfilling the conditions stated in the description under the competition entry.
Each contestant can win a maximum of one prize during the entire duration of the competition under the conditions set by these rules. If a contestant is drawn as a winner, this contestant (or all his/her registrations) is eliminated from the competition and will no longer participate in the next draw, and in the event of another drawing of the same contestant (e.g. a new registration), the draw will not be taken into account and the draw is repeated.
5. Mechanism for determining winners
The winners will be determined by lottery, so that on the first working day after the end of the competition, the Organizer will draw the number of winners specified in the description of the competition entry.
A participant who fully complies with the rules of this competition and is duly drawn, wins one of the prizes listed in the description of the competition entry according to the draw.
Each contestant can win a maximum of 1 prize. In the case of repeated raffling of a competitor, his participation is no longer taken into account.
6. Prizes and Transfer of Prizes
Prizes are determined individually for each competition entry, namely in its description.
The winner, if any, will be notified via private messages within the given social network within 5 working days after the end of the draw for the respective competition week. As part of the contact, the contestant will be asked to send a phone number, email and delivery address in the Czech Republic or Slovakia, in order to send the prize, within 60 working days from the date of sending a private message from the Organizer.
If the winner does not respond according to the instructions in the message sent (in particular, does not confirm his e-mail address and send the delivery address within the specified period), his prize will be forfeited to the Organizer without compensation.
Prizes will be sent to those winners who have met the conditions of these rules. Prizes will be sent no later than 60 days after the Organizer receives the winner's telephone number and delivery address in accordance with these rules.
Prizes will be sent exclusively via the operator of delivery services to a confirmed delivery address in the territory of the Czech Republic or Slovakia.
The contest organizer is not responsible if private messages are saved (so-called falling) into the competitor's spam or junk mail. The competitor is responsible for checking the mail to this extent as well.
The organizer is not responsible for non-delivery of the prize due to an incorrectly entered e-mail or delivery address or other necessary data or technical problems or transport problems of the delivery person.
In case of non-fulfillment of any of the requirements according to these rules, the winner's right to win expires and his winnings are forfeited to the Organizer without compensation.
All contact details must be truthfully communicated to the Organizer and must be valid during the entire duration of the competition. In the event that any contact information changes during the relevant period on the part of the participant of the competition, he is obliged to notify the Organizer of this change.
Undeliverable shipments after the end of the competition are forfeited to the Organizer. In the event that the Contest Organizer fails to repeatedly contact the winner in the specified manner within 14 calendar days from the end of the contest week, the winner does not send his reply within the specified period or fails to deliver the prize to the specified delivery address, this prize will be forfeited to the Contest Organizer, who is entitled decide on its use.
7. General conditions
Only those participants who fully meet the specified conditions of the competition will be included in the competition. The organizer of the competition has the right to assess the fulfillment of the specified conditions of the competition by individual participants.
Persons who do not meet the conditions for participation in the competition or act in violation of the rules will not be included in the competition. If it turns out that this person has become a winner despite the above, e.g. as a result of false information they have provided, they are not entitled to the prize.
In the event that the participant does not meet the conditions of this competition or in the event that the Organizer has reasonable suspicion that the competitor achieved the result in the competition by fraudulent behavior or other behavior that is contrary to good morals or public order and is capable of influencing the results of the competition, The organizer is entitled to exclude the participant from the competition. In the same way, the participant will be excluded in the event that the Organizer discovers or has a justified suspicion of committing fraudulent or unfair behavior on the part of one of the participants or another person who helped the given participant to win the prize. This decision to disqualify a contestant is final and non-appealable.
In the event that it turns out that the winner does not have the right to win according to these rules for any reason, or if the winner refuses the prize, the Organizer will draw another contestant as the winner of the prizes in question, or another registration of the competition receipt and thus the competitor who has fulfilled all the conditions of participation in the competition, or uses the winnings for other, e.g. marketing or charitable, purposes.
8. Personal data and personality rights
FIXED.zone as, IČO 26036363, with registered office at Kubatova 6, 370 04, České Budějovice, Czech Republic, is the Administrator of the personal data of the participants of this competition.
Personal data of competition participants (name, surname, e-mail address and, in case of winning, telephone number and delivery address) are collected and processed only for the purpose of conducting the competition (including delivery of prizes) in accordance with the provisions of the general regulation of the European Parliament and the Council (EU ) 2016/679 on the protection of personal data of April 27, 2016 (GDPR). Personal data will be processed in accordance with the Consumer Privacy Policy.
The obligation to fulfill the contract concluded between the Data Controller and the participant constitutes the legal basis for the processing of the participant's personal data (in the sense of Article 6, paragraph 1, letter b) of the GDPR). The aforementioned contract is these general terms and conditions. The data controller will provide the contact details of the entrant-winner to postal or courier service providers for the purpose of delivering the prize to the winner. The data collected in the competition relating to the participants to whom the Data Controller has awarded prizes will be processed by the Data Controller for a period of 10 years.
9. Final Provisions
Participation in the competition is voluntary. By participating in the competition, the contestant expresses his agreement with these rules and undertakes to fully comply with them.
Rights and obligations arising in connection with the competition, which are not regulated in these rules, are governed by the legal regulations of the Czech Republic. The organizer is responsible and takes full responsibility for the setup, conditions and organization of the competition.
The organizer bears no responsibility for any risks and liabilities related to participation in the competition or in connection with the use of winnings. The risk of damage to the prize passes to the winner at the time the prize is handed over to the winner.
The winner cannot claim a prize other than the one awarded to him and is not entitled to claim the prize. It is not possible to alternatively pay out the winnings in cash or in any other way. Winnings cannot be claimed through court.
The organizer is not responsible for errors or malfunctions on the part of telecommunication/internet service providers or delivery service providers.
Prizes possibly depicted in advertising materials are illustrative and may not correspond to the actual prize received, especially in terms of color and motif.
The results of the competition are final, without the possibility of appeal. The final decision on disputed issues always rests with the Organizer.
Winnings from the advertising competition (value exceeding CZK 10,000) are subject to withholding tax in the amount of 15% according to Act No. 586/1992 Coll., on income taxes, which the Organizer undertakes to properly pay. If the winner is not a tax resident of the Czech Republic, he/she must provide proof of his/her tax domicile to the Organizer within 5 days of confirmation of the prize in the competition. If they do not do so, the Promoter will withhold and remit a tax of 15% of the prize (if it is not tax-exempt) in the Czech Republic.
The materially competent entity for the out-of-court settlement of consumer disputes related to the competition is the Czech Trade Inspection, Štěpánská 567/15, 120 00 Prague 2, website: www.coi.cz. Here, the competitor will find, among other things, information on the method and conditions of out-of-court dispute resolution, when this procedure can only be initiated on the basis of the competitor's proposal and then when he fails to resolve the dispute directly with the Organizer. The proposal form for initiation of proceedings on the out-of-court settlement of a consumer dispute is available on the website of the Czech Trade Inspection.
